I freely acknowledge and realize the risks of participating in the activities of Scootseeing Vienna and fully assume all responsibility including but not limited to, collision with pedestrians, vehicles, other riders, and/or fixed moving objects, the negligence of other riders and dangers arising from falls and road surfaces, as well as the possibility of physical and/or mental trauma or injury.
I realize that Scootseeing Vienna requires physical exertion and I represent that I am in sound medical condition capable of participating in the ride without risk to others or myself. I agree to follow all traffic laws, signs, rules and regulations. I agree that I will, at all times during my participation in the Tours, adhere to all safety rules and regulations, which includes wearing a helmet while riding my Scooter. I, as a parent or guardian, take responsibility for any of my child’s actions for the duration of the trip.
As a Sightseeing Tour participant, I am responsible for any damage that might occur while I am riding. I, as a responsible adult, will not use my cellular phone, camera, video camera or other items that involve the use of my hands while riding on the tour, due to the disruption it may cause to my concentration and the enjoyment of others on the tour. I hereby release, indemnify and agree to hold harmless Scootseeing Vienna, its officers, owners, directors, representatives, employees, agents, and participants of and from any and all losses, costs, damages, claims, demands, rights and causes of action of whatever kind or nature, including reasonable attorney fees, and including any and all negligence claims or causes of action, which may arise and which result from illness, personal injuries, property damage, death or of any other damages or injuries, not included herein, occurring during or as a results of my participation in the Scooter SighteeingTours.
In case of accident, the rider does not enjoy the protection of „responsabilité civile circulation“ and instead engages his or her personal civil insurance. I also consent to and permit emergency medical treatment in the event of injury or illness. I understand and accept that any medical cost incurred with respect to my medical treatment will be my responsibility.
Please be aware that according to the manufacturer´s specification and Austrian law the following restrictions apply for Scooter:
Minimum age: 12 years, Minimum height: 150 cm, Body weight: between 45 kg and 120 kg
Therefore people who fall within these limits cannot participate in Tours. Exclusion from a booked tour on account of the restrictions does not qualify for a refund.
If, for whatever reason, you do not show up for the Scooter tour you booked and did not cancel in writing (email) before the 48 hour cancellation limit, you hereby agree that we can book the full tour cost from your credit card. (Exception is tour cancellation by Scooter tour due to bad weather.)
Any and all litigation will be subject to Austrian law and will occur in Vienna, Austria. I am of legal age and fully competent, have read this Waiver and Release and fully understand it. If not of legal age, my parent or legal guardian has fully read the above Waiver and Release and understands it.

Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.
For technical reasons, the following data sent by your internet browser to us or to our server provider will be collected, especially to ensure a secure and stable website: These server log files record the type and version of your browser, operating system, the website from which you came (referrer URL), the webpages on our site visited, the date and time of your visit, as well as the IP address from which you visited our site.
The data thus collected will be temporarily stored, but not in association with any other of your data.
The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website.
The data will be deleted within no more than seven days, unless continued storage is required for evidentiary purposes. In which case, all or part of the data will be excluded from deletion until the investigation of the relevant incident is finally resolved.
